You should carefully read the following terms and conditions
before registering for a commercial account. Your use of this
software indicates your acceptance of this license agreement.
This is a legal agreement (this "Agreement") between you (either
an individual or an entity) and Anfy Team Company ("Anfy Team").
This Agreement is part of a web site containing a software
(hereby called "ANFY FLASH") for creating web effects based
on Macromedia Flash (TM) (hereby called "THE EFFECTS").
1. GRANT OF LICENSE. Anfy Team hereby grants you a personal,
non-exclusive, non-transferable license to use one account
of this Software. This grant of license gives the right to
use material created with THE ANFY FLASH on an unlimited number
of web sites or on your computer. You may not decompile, disassemble,
or reverse engineer THE ANFY FLASH and THE EFFECTS, and you
may not create derivative works of THE ANFY FLASH and THE
EFFECTS, including (without limitation) for the purpose of
obtaining unauthorized access to THE ANFY FLASH. You agree
not to access THE ANFY FLASH by any means other than through
the interface that is provided by Anfy Team for use in accessing
THE ANFY FLASH. You may modify, translate or adapt the HTML
code provided with THE EFFECTS. You are not granted any right,
title, or interest in THE ANFY FLASH or THE EFFECTS except
the right to use it in accordance with this Agreement.
2. USE AND STORAGE You acknowledge that Anfy Team may establish
limits concerning use of the Service. Currently, each ANFY
FLASH account allows particular individuals to have 2 MB of
disk space for his or her files.
3. REDISTRIBUTION. Redistribution and reselling of THE EFFECTS
is allowed together with it's necessary images and sound files.
4. MODIFICATIONS TO THE ANFY FLASH Anfy Team reserves the
right at any time and from time to time to modify or discontinue,
temporarily or permanently, THE ANFY FLASH or THE EFFECTS
(or any part thereof) with or without notice. You agree that
Anfy Team shall not be liable to you or to any third party
for any modification, suspension or discontinuance of the
Service.
5. WARRANTY.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
(a) YOUR USE OF THE ANFY FLASH AND OF THE EFFECTS IS AT YOUR
SOLE RISK. THE ANFY FLASH IS PROVIDED ON AN "AS IS" AND "AS
AVAILABLE" BASIS. ANFY TEAM EXPRESSLY DISCLAIMS ALL WARRANTIES
OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT
LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS
FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
(b) ANFY TEAM MAKES NO WARRANTY THAT (i) THE ANFY FLASH
WILL MEET YOUR REQUIREMENTS, (ii) THE ANFY FLASH WILL BE UNINTERRUPTED,
TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY
BE OBTAINED FROM THE USE OF THE ANFY FLASH WILL BE ACCURATE
OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION,
OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE
ANFY FLASH WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS
IN THE SOFTWARE WILL BE CORRECTED.
(c) ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH
THE USE OF THE ANFY FLASH IS DONE AT YOUR OWN DISCRETION AND
RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE
TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM
THE DOWNLOAD OF ANY SUCH MATERIAL.
(d) NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED
BY YOU FROM ANFY TEAM OR THROUGH OR FROM THE SERVICE SHALL
CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS USER LICENCE
AGREEMENT.
6. COPYRIGHT. THE ANFY FLASH and THE EFFECTS are owned by
Anfy Team and are protected by Italian copyright law and international
treaty provisions.
7. TERMINATION. The license will terminate immediately without
notice from Anfy Team if you fail to comply with any provision
of this license. You agree that Anfy Team, in its sole discretion,
may terminate your password, account, use of THE ANFY FLASH
or use of any other ANFY FLASH service, and remove and discard
any Content within your account, for any reason. You agree
that any termination of your access to THE ANFY FLASH under
any provision of this license agreement may be effected without
prior notice, and acknowledge and agree that Anfy Team may
immediately deactivate or delete your ANFY FLASH account and
all related information and files in your ACCOUNT and/or bar
any further access to such files or THE ANFY FLASH. Further,
you agree that Anfy Team shall not be liable to you or any
third-party for any termination of your access to the Service.
8. LIMITATION OF LIABILITY. IN NO EVENT WILL ANFY TEAM OR
ITS SUPPLIERS BE LIABLE FOR ANY LOST REVENUE, PROFIT, OR FOR
DIRECT, SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR PUNITIVE
DAMAGES HOW EVER CAUSED AND REGARDLESS OF THEORY OF LIABILITY,
ARISING OUT OF THE USE OF OR INABILITY TO USE THE ANFY FLASH
AND THE EFFECTS, EVEN IF ANFY TEAM HAS BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES.
9. GOVERNING LAW. This agreement is made under, shall be
governed by and construed in accordance with, the laws of
the court of Lucca, Italy.
10. TAXES. You agree to be responsible for and to pay, and
to reimburse Anfy Team on request if Anfy Team is required
to pay, any sales, use, or other tax (excluding any tax that
is based on Anfy Team' net income), assessment, duty, tariff,
or other fee or charge of any kind or nature that is levied
or imposed by any governmental authority on your rent of the
software package.
